“ClubQ8” General Terms and Conditions

These general terms and conditions of contract (referred to as 'GTC') govern participation in ClubQ8, a program dedicated to Q8 customers by Kuwait Petroleum Italia S.p.A. (hereinafter "Q8"), with registered office in Rome, Viale dell'Oceano Indiano 13.

ClubQ8 provides Members with exclusive benefits and access to services listed in Art. To become a Member, please refer to Article 3 (hereinafter referred to as "Member" or "Members") the below. 1.3, as well as any additional services that may be introduced. These services are available at authorized Q8 and/or Q8 Easy brand service stations (hereinafter referred to as "Points of Sale").

Members, upon the occurrence of the conditions indicated in these GTCs, will be able to use the following services:
(A) Electronic Purse Service: The Member can use an electronic wallet to purchase fuel at enabled Points of Sale. The electronic purse can be accessed using the Customer Identification Code, as defined below, and must be used in accordance with the terms outlined in Article 4. (B) Dedicated promotional initiatives and other benefits: The Member can participate in Q8's promotional initiatives for Q8 Club Members using the Customer Identification Code, as defined below. These initiatives may include prize events, sometimes in partnership with third parties. Additionally, Members can take advantage of any discounts or benefits offered to them. Members may be required to accept specific contract conditions and/or regulations to participate in certain benefits or promotional initiatives, such as prize competitions. The conditions or regulations in force at the time will govern these initiatives, and they will be available on the www.q8.it website or in the App.
(C) Newsletter Service: the Member will receive, at the e-mail address provided at the time of registration, a newsletter containing news, data, information and insights on topics of interest as well as communications regarding promotional initiatives and/or prize events dedicated to ClubQ8 members.
(D) Payment by App: the Member may make payment for fuel purchases at the Authorized Points of Sale through the app dedicated to the Q8 Club (hereinafter "App") using the available payment methods.

In any case, the following are excluded from participation: (i) the managers of Q8 and Q8easy brand service stations, their collaborators and their family members; (ii) the contractors of Q8 and Q8easy brand service stations, their collaborators and their family members.

ClubQ8 it is reserved for natural persons, of legal age, with a tax code issued by the competent Italian Authority (hereinafter "Tax Code")

Registration to ClubQ8 can be made at authorized Points of Sale, through the www.Q8.it website (hereinafter "Website"), or through the other digital channels that Q8 may make available. At the time of registration, the Member is provided with an identification code (hereinafter "Customer Identification Code") to use the Services.

You can register with ClubQ8 in the following ways:

registration at authorized Points of Sale: The Customer provides the personal data for ClubQ8 registration through the POS located at the petrol stations (mobile phone number and tax code, obtained by swiping the health card) and at the same time accepts these General Terms and Conditions; the registration is completed only after the provision of these data and the confirmation of the telephone number by means of the PIN obtained at the same number. If you apply to join ClubQ8 and the StarQ8 Programme at the same time, you will receive a physical card (hereinafter referred to as the "StarQ8 Card"); in this case, the Customer Identification Code is the number of the StarQ8 Card.
In the event of failure to issue the Tax Code during registration (for example, in the event of malfunction or unavailability of the health card) as well as in the event of failure to confirm the mobile number by PIN, the customer can complete the registration through the link received via text message. The registration must be completed within 15 (fifteen) days from the beginning of the procedure, after which the Customer Identification Code and the data associated with it will be deleted.

To use certain services, such as the newsletter service or certain features or benefits related to competitions, the member must provide an e-mail address. In the case of ClubQ8 registration at POS, the Member may provide the e-mail address by accessing the website through the link provided by SMS to the number provided during registration and following the appropriate double opt-in procedure. To benefit from certain advantages and participate in certain promotional initiatives (such as prize draws), the Member may accept specific contractual conditions and/or regulations. In any case, specific initiatives will be governed by the conditions or regulations in force from time to time, which will be available on the www.q8.it website or in the App.

Members who have performed the procedure referred to in Article 3 have an electronic purse for fuel purchases, which can be used at authorized points of sale, the list of which is available on the website (hereinafter "Electronic Purse").

Members can use this payment system through a Customer Identification Code. The Electronic Purse is a privative tool, i.e., with limited expendability, pursuant to Article 2, paragraph 2, letter m) of Legislative Decree no. 11 of January 27, 2010, as amended, and related regulatory provisions and is therefore guaranteed exclusively for the purchase and payment of fuel supplies made by the Member at authorized Service Stations.

The electronic purse can be recharged and used within the limits indicated below:

can be recharged up to a maximum of €500.00/day and €1,500.00/month;

can be recharged with amounts of at least €20;

can be used for purchases of up to €250.00/day or €750.00/month of your available credit in the case of a Motorist customer and up to €750.00/day or €2,250.00/month in the case of a Driver customer.

Electronic Purse can be recharged: i) at authorized Point of Sales, with payment in cash or with credit cards accepted at the same service station; ii) via the Website or other channels, by accessing the dedicated area, with payment by credit card and/or with other payment methods that may be made available in the future, including so-called proximity payment instruments. There is no recharge fee. After each recharge, the Member will receive confirmation of the successful completion of the transaction with a message sent through the recharge channel used (POS, website or any other available digital channel). The Member can check the active balance and the list of transactions by accessing his/her reserved area on the Website.

To make purchases using the Electronic Wallet service, the credit must cover the entire cost of the purchase. No partial supplement of the amount may be made using other payment methods. The receipt issued at the end of each purchase transaction will indicate to the Member the amount paid and the remaining balance.

The Electronic Purse Service can be used in the following ways: i) Members who have a StarQ8 Card can make purchases at authorized Points of Sale, by swiping the StarQ8 Card - or by entering the Customer Identification Code associated with it on the POS - and entering the PIN received during registration; ii) Members who only have a Customer Identification Code (and not a StarQ8 Card) must access the appropriate section of the Website or through other digital channels before making a purchase and generate an 8-digit payment code (hereinafter "Code" or "Codes"), choosing the desired denomination and validity of the Code; payment can be made by typing the code generated within the chosen validity period on the POS.

The Member may deactivate the Electronic Purse Service, upon notice to Q8, with 30 (thirty) days' notice. In the event of deactivation, the Member has the right to a refund of any balance in the Electronic Purse.

Through the App, the Member will be able to generate Codes that can be used to make fuel purchases at the Points of Sale by making the relevant payment using the payment instruments made available from time to time by Q8.
The Member can generate codes through the App using the "Pay with PayPal" feature. In this case, the Member must enter his/her PayPal credentials and obtain authorization to generate an 8-digit code. The Member must then select the amount of the Code to be generated within the limits specified below. The individual codes generated by the "Pay with PayPal" function may not have an amount greater than 100 (one hundred) euros; in any case, the Member may not generate codes for an amount greater than 150 (one hundred and fifty) euros per week (from Monday to Sunday).
The Code will be valid for 10 minutes. Once the Code has been generated, the Member will receive a payment authorization message from PayPal. The Member must then enter the Code on the keypad of the banknote and bank card acceptor, put the mobile phone in the car or turn off the mobile phone and only then dispense the fuel. At the end of the disbursement operation, the amount corresponding to the refueling carried out will be debited from the Member's PayPal account, which cannot exceed the amount pre-authorized at the time of Code generation.
The Member who wishes to pay through PayPal can use the "Remember my data" function, which can be selected in the "Settings" menu of the App. This feature allows the Member to automatically use his/her PayPal credentials for all purchases made through the App. The Member may disable the "Remember My Info" feature at any time in the Member's reserved area of the Website or the App.
The Member may use the "Pay with PayPal" feature as long as it is available within the App.

As part of the prize draws, the Member will be able to take advantage of special benefits and partnerships with third party companies, also for the purpose of recognizing points useful for requesting prizes. As part of the Prize Draw, the delivery of the prizes requested by the Member will be managed by the Company in partnership with Amazon EU S.a.r.l..

Members may also participate in the prize competitions (hereinafter "Prize Events") dedicated to them, subject to acceptance of the specific regulations.

Members may participate in dedicated promotional initiatives, also in partnership with third parties.

The Member may withdraw from the contract at any time by giving Q8 at least 30 (thirty) days notice in writing to clienticlub@q8.it. In case of withdrawal, the Member loses the right to enjoy all the services related to ClubQ8, including the participation in the related prize events. It is understood that in case of cancellation, the Member is entitled to a refund of any credit in the electronic wallet.

Participation in ClubQ8 is for an indefinite period. However, Q8 reserves the right to terminate the provision of any or all of the ClubQ8-related services with at least 6 (six) months' notice.

Kuwait Petroleum Italia S.p.A. will make every effort to maintain uninterrupted access to the Services. In the event of an interruption, the company will work to restore access as quickly as possible. It is important to note that interruptions or malfunctions caused by telecommunications operators, electrical lines, or other public utility services, as well as malfunctions of smartphones or other communication systems used by the Member to access the Website or the App, are not within the control of Kuwait Petroleum Italia S.p.A. We apologize for any inconvenience this may cause.

XX may perform periodic checks on the usage of the Customer Identification Code and the StarQ8 Card, including their respective codes, at any given time. Q8 retains the right to deactivate them if any irregularities that suggest fraudulent activity are detected, and to promptly notify the appropriate authorities of such occurrences. It is understood that Kuwait Petroleum Italia S.p.A. will fully cooperate with the authorities in cases of judicial and police investigations involving crimes committed through the illicit or fraudulent use of Customer Identification Codes, StarQ8 Cards, or Codes. Kuwait Petroleum Italia S.p.A. is committed to providing technical and operational collaboration to competent authorities, including personal data associated with subscribers as communicated at the time of registration and any other information related to the contractual relationship underlying the service. This will be done without prior notice to the respective owners upon request, as outlined in Section 7.4.

One of the potential risks associated with the service is the possibility of fraudulent use by third parties of the Customer Identification Code or the StarQ8 Card and its related PIN, as well as the Codes already generated by the Subscriber in case of loss, theft, counterfeiting, or negligent custody. The Subscriber is kindly reminded of their responsibility to safeguard the Customer Identification Code and, if applicable, the StarQ8 Card assigned to them, as well as the PIN provided to them upon registration. It is recommended that the PIN be kept confidential and not shared with third parties, nor written on the StarQ8 Card or stored with personal documents. The subscriber is kindly reminded of their responsibility to safeguard the codes generated in accordance with the procedures outlined in Article 4. It is of utmost importance to ensure that these codes remain confidential and are not disclosed or stolen by any unauthorized parties. It is recommended that the Subscriber notify Q8 in a timely manner in the event of any loss of exclusive control over their Customer Identification Code or StarQ8 Card, as outlined in Article 7 below. This will help ensure that all transactions and/or operations performed with the Codes are accurately attributed. It is important to note that failure to do so may result in the Subscriber being held responsible for any transactions and/or operations made with the Codes. In case of counterfeiting, loss, unauthorized removal, or fraudulent or unauthorized use of the Customer Identification Code, the StarQ8 Card, or the Codes, Q8 will require notification from the Subscriber and follow the procedures outlined in Article 7 below before issuing any refunds.

The Customer Identification Code and StarQ8 Card are intended for personal use only. It is important to note that any misuse of these items is considered a criminal offense under the law. Kuwait Petroleum Italia S.p.A. retains the right to limit the use of the Customer Identification Code and may request the return of the StarQ8 Card at any time.

In the event of theft, loss, damage, or malfunction of the Customer Identification Code or the StarQ8 Card, the Member has the option to block them.

you can proceed with the operation directly at the POS terminals located at authorized Points of Sale, by requesting the operator to perform a 'CARD BLOCK' operation. To carry out the operation, it is necessary to have the health card, which must be inserted into the POS terminal at the Point of Sale. Following this operation, Q8 will promptly proceed to block the Customer Identification Code or the StarQ8 Card associated with the fiscal code identified through the health card;

Alternatively, you can use the IVR telephone service (800.01.08.08), selecting the 'CARD BLOCK' option and following the provided instructions.

You can also perform the operation through the reserved area of the Website or other available digital channels.
After blocking, the Customer ID or StarQ8 Card will no longer function and will no longer be able to use the Services. If a blocked StarQ8 Card has been found, it must be deleted or otherwise no longer used.
To continue using the services, a member must request a new StarQ8 Card at an authorized point of sale if he already has a StarQ8 Card or a new Customer Identification Code through the website. Cards reported as damaged, malfunctioning, stolen, or lost will still be included in a special block list. In the event of loss or theft of generated codes, a member may request their blocking by calling 800.01.08.08.

In case of theft or loss of the device (for example, smartphone, tablet) through which the App is used and to which payment methods are possibly connected (for example, PayPal credentials), the Member is required to promptly deactivate the functionality of generating Codes by accessing the reserved area available on the Website. Similarly, if the Member has activated, about PayPal credentials, the "Remember my data" function, the Member is required to promptly deactivate this function within his/her reserved area of the Website or App.

In the event of theft or loss of the PIN, the Member may request the generation of a new PIN code at the authorized Points of Sale or by any other means that may be made available by Q8. In this case, the Member must be provided with a health card (the same provided at the time of joining), which must be swiped again at the POS to verify that the applicant is the cardholder. During this operation, the mobile phone number previously entered by the Member will be made visible and on which the new PIN will be sent via SMS. The subscriber will have the possibility, if desired, to change the mobile number by requesting the operator to perform the appropriate transaction "Mobile Number" through the POS.

If he/she only has the Customer Identification Code, in the event of loss, theft, or damage of the device (e.g., tablet or smartphone) to which this code is connected, the Member must deactivate the association between the device and the Customer Identification Code by accessing the reserved area available on the Website. Kuwait Petroleum Italia assumes no responsibility for any consequences deriving from the impossibility or delay in deactivating the association between the Customer Identification Code and the device used.

Q8 may modify, in whole or in part, these General Contractual Conditions (GCC) at any time for justified reasons, such as the development of services and the App, changes in the technical and commercial costs incurred for the provision of services a change in the competitive context that impacts the commercial offering, as well as for technical or managerial needs and/or changes in the applicable regulations, by informing the Subscribers at the contact details provided upon registration, at least 15 days before the date set for the application of such changes.

The changes will be deemed accepted by the Subscriber, unless the Subscriber communicates in writing to Q8, before the date set for the application of the changes, their intention to terminate the contract.

Q8 reserves the right to introduce additional services within the ClubQ8 framework beyond those listed above, as well as new functionalities of the App and/or new and additional usage methods (for example, the introduction of additional payment methods or additional channels for accessing services) that do not alter the nature and main characteristics of the services already provided in the GCC. Users will be notified of any additional services through notices posted on the Website and the App or via the contact details provided. It is understood that such additions shall not be considered as modifications to the GCC under Article 9.1 above.

It is hereby understood that mandatory provisions of a regulatory and regulatory nature that result in changes or additions to the discipline contained in the GCC will automatically and legally be incorporated into these GCC.
Q8 will process the Members personal data according to the terms and methods outlined in the Privacy Policy attached to these GCC and available for consultation on the website www.q8.it, in the section dedicated to Club Q8. Any updates to the Privacy Policy will be communicated to Subscribers at the contact details provided upon registration.
It is hereby understood that in cases of judicial and police investigations concerning crimes committed through the illicit use of the StarQ8 Card or the Customer Identification Code, Q8, if required under applicable regulations, will provide necessary cooperation to the competent authorities, including providing, if requested and without prior notice to the respective individuals concerned, the personal data of the Subscriber associated with the Customer Identification Code or the StarQ8 Card in question, as communicated toQ8 at the time of registration, and any other information in its possession related in any way to the existing contractual relationship.
These GCC will be governed by Italian law, and for any dispute arising from the interpretation, execution, or termination of these terms, the competent jurisdiction, by Legislative Decree no. 206/2005, will be the court of residence or domicile of the Subscriber, if a consumer.
